Payment Terms
Last updated: December 26, 2024
These Payment Terms govern all financial transactions between you and Caxaqua in connection with the use of our services. By purchasing or subscribing to any service offered through caxaqua.com, you agree to the terms set out below. Please read them carefully before completing any transaction.
1. Scope of Application
These Payment Terms apply to all clients, individuals, and organisations that purchase, subscribe to, or otherwise access paid services provided by Caxaqua. They form part of the broader agreement between you and Caxaqua and should be read alongside our Terms of Service and Privacy Policy.
2. Pricing and Service Fees
All fees for services are presented at the time of purchase or subscription. Prices are displayed in the applicable currency and are inclusive or exclusive of applicable taxes as stated at checkout. Caxaqua reserves the right to modify pricing at any time. Any changes to pricing will be communicated to existing clients in advance and will not apply retroactively to active billing periods already paid.
Custom service engagements, individual work plans, and specialist consultations may be subject to individually agreed pricing, which will be confirmed in writing prior to any charge being applied.
3. Billing and Payment Schedule
3.1 Subscription Services
Where services are offered on a recurring subscription basis, billing occurs automatically at the start of each billing period, which may be monthly, quarterly, or annual depending on the plan selected. You authorise Caxaqua to charge the payment method on file at the beginning of each period.
3.2 One-Time Payments
For services billed as a single transaction, payment is due in full at the time of purchase before access to the service is granted.
3.3 Custom Engagements
For individually scoped work, payment schedules will be defined in a separate written agreement or service proposal. Milestone-based billing may apply where agreed in advance.
4. Accepted Payment Methods
Caxaqua accepts payments through the methods made available at the point of checkout. These may include major credit and debit cards, bank transfers, and other electronic payment solutions. All payment processing is handled through secure, third-party payment providers. Caxaqua does not store full payment card details on its own systems.
Payments must be made in the currency specified at checkout. Any currency conversion fees or international transaction charges imposed by your bank or payment provider are your responsibility.
5. Taxes and Duties
You are responsible for any taxes, duties, levies, or similar charges that may apply to your purchase under the laws of your country or region. Where Caxaqua is required to collect applicable taxes, these will be itemised and added to the total at checkout. If you are a business client eligible for tax exemption, you must provide valid documentation before the transaction is completed.
6. Failed and Declined Payments
If a payment is declined or fails for any reason, access to the relevant service may be suspended until the outstanding amount is settled. Caxaqua will make reasonable attempts to notify you of a failed payment using the contact details associated with your account. It is your responsibility to ensure that valid and current payment information is maintained at all times.
Caxaqua is not liable for any service interruption resulting from a failed payment caused by insufficient funds, expired payment credentials, or actions taken by your payment provider.
7. Refund Policy
7.1 General Position
All fees paid to Caxaqua are generally non-refundable unless explicitly stated otherwise in a service-specific agreement or as required by applicable law. This applies to subscription fees, one-time service charges, and deposits for custom engagements.
7.2 Exceptions
Refund requests may be considered at Caxaqua's sole discretion in cases where a technical failure on our part directly prevented access to a service for a significant portion of a paid period, or where a billing error resulted in an incorrect charge. Any approved refund will be returned to the original payment method within a reasonable timeframe.
7.3 Cancellation Before Service Commencement
If you cancel a confirmed order or engagement before any work or access has commenced, a partial or full refund may be available depending on the nature of the service and any preparation costs already incurred. This will be assessed on a case-by-case basis.
8. Cancellation of Subscriptions
You may cancel a recurring subscription at any time through your account settings or by contacting Caxaqua directly. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time remaining within a paid period unless otherwise agreed. Following cancellation, your access to the service will continue until the end of the period for which payment has been received.
9. Disputes and Chargebacks
If you believe a charge has been applied incorrectly, you should contact Caxaqua at contact@caxaqua.com before initiating a dispute or chargeback with your payment provider. Caxaqua will investigate and respond to billing queries promptly.
Initiating a chargeback without first contacting Caxaqua may result in suspension of your account pending resolution. Caxaqua reserves the right to contest chargebacks that are found to be unsubstantiated.
10. Late Payments
For services billed on invoice or under a custom engagement agreement, payment is due by the date specified on the invoice. Overdue amounts may be subject to a late payment fee or interest charge as specified in the relevant agreement. Caxaqua reserves the right to suspend services until all outstanding balances are cleared.
11. Changes to These Payment Terms
Caxaqua may update these Payment Terms from time to time to reflect changes in our services, pricing structures, or operational requirements. The most current version will always be available on our website. Where changes are material, we will provide advance notice to active clients. Continued use of our services following the effective date of any update constitutes acceptance of the revised terms.
