Please read these Terms of Use carefully before accessing or using any part of the Caxaqua platform or services. By accessing or using the service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the service.
1. Definitions
"Service" refers to the Caxaqua platform, website, tools, and related services made available at caxaqua.com.
"User," "you," or "your" refers to any individual or entity accessing or using the Service.
"Company," "we," "us," or "our" refers to Caxaqua, the provider of the Service.
"Account" refers to the registered profile created by a User to access the Service.

By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. 3. Account Registration

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at contact@caxaqua.com if you become aware of any unauthorised use of your Account or any other security breach.
We reserve the right to suspend or terminate Accounts that contain inaccurate information or that are used in violation of these Terms.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that:

Nothing in these Terms grants you any ownership right in the Service or its content.

You retain ownership of any Content you submit to the Service. By submitting Content, you grant Caxaqua a non-exclusive, worldwide, royalty-free licence to use, store, process, and display your Content solely to the extent necessary to provide and improve the Service. You represent and warrant that you have all rights necessary to grant this licence.
5.3 Feedback
If you provide suggestions, ideas, or feedback regarding the Service, you grant us the right to use such feedback without restriction or compensation to you.
6. Fees and Payment
Certain features of the Service may require payment. All applicable fees will be disclosed prior to purchase. You agree to pay all fees in accordance with the pricing and payment terms presented at the time of purchase.
All payments are non-refundable unless otherwise stated in a separate refund policy or required by applicable law. We reserve the right to modify pricing at any time, with reasonable notice provided to existing users where applicable.
7. Subscription and Cancellation
If you subscribe to a recurring plan, your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time through your Account settings or by contacting us at contact@caxaqua.com. Cancellation takes effect at the end of the current billing period.
8. Third-Party Services and Links
The Service may contain links to third-party websites, tools, or services. These are provided for convenience only. We do not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
9. Availability and Modifications
We strive to maintain consistent availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Caxaqua disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will meet your specific requirements, that it will be uninterrupted, timely, secure, or free from errors, or that any defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Caxaqua and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from or related to your use of or inability to use the Service.
Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the greater of the amount you paid to us in the twelve months preceding the claim or one hundred euros (€100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Caxaqua and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses - including reasonable legal fees - arising out of or in any way connected with your use of the Service, your Content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required to do so by law. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification.
14. Governing Terms
These Terms constitute the entire agreement between you and Caxaqua regarding your use of the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
